The Website is operated by MCCREEDY SA, Schipfe 2/8, 8001 Zürich, Switzerland ("MCC SA").
These Terms and Conditions apply to:
(1) the use of the Website (including the use of applications and downloads that are owned and controlled by MCC SA and that are available through the Website or interact with the Website);
(2) the purchase of products through the Website (the "Purchase(s)"); and
(3) the use of all other services offered through the Website.
In addition, please review the Privacy Policy , which explains our information collection practices, such as the types of information we collect regarding visitors to the Website and how we may use that information. By using the Website, you acknowledge and accept the Privacy Policy and consent to the collection and use of your data in accordance with the Privacy Policy.

By accessing, browsing or otherwise using the Website, you indicate your agreement to these Terms and Conditions. If you do not agree to these Terms and Conditions, then you are not authorised to continue the use of the Website or the Services or making Purchases.
1. Conditions of Use
You shall ensure that your use of the Website and Services and your Purchases are in accordance with all the relevant legislation, regulations, codes of practice, guidance and other requirements which may apply. You must not use the Website, Purchases or Services for or in connection to any unlawful purpose whatsoever.
MCC SA has the right to delete or remove any content that has been uploaded to the Website in breach of these Terms and Conditions and may refuse to accept Purchases, provide Services and/or suspend your use of the Website.
2. Accessing the Website
MCC SA reserves the right to withdraw, restrict or amend access to the Website and/or the Services without prior notice. MCC SA is not liable if for any reason the Website is unavailable at any time.
If you register for the Website, you are asked to provide a username and password. You must treat such information as confidential and not disclose it to third parties. You may be held responsible for any losses incurred as a result of unauthorised access due to your failure to keep such information secure.
3. Making Purchases
(a) The product offering on the Website is subject to availability. All price indications are non-binding.
(b) Any Purchase is subject to submission of a duly completed online form or, for registered clients, the log in with the personal username and password. You represent and warrant that the information you provide is correct.
(c) Orders via the Website will be processed as follows: Once you have chosen a product, click to the “Add to Cart” button. [Please note that certain products may not be added to your cart and will require you to contact a sales representative.] Once you have added all products you wish to order, you may proceed to checkout by clicking the “Checkout” button. You will then be required to enter your payment and billing details and, if applicable, separate delivery information. You may finalise your order by clicking the “Place your Order” button.
(d) An automated e-mail will be sent to you once you have placed your order. Such e-mail merely acknowledges the receipt of your order. It does not constitute a legally binding confirmation of the Purchase and may not be read or construed as MCC SA’s acceptance of the Purchase. MCC SA reserves the right to refuse any order without giving reasons.
(e) By placing an order, you are making an offer to MCC SA to purchase the products in accordance with the Terms and Conditions. The purchase agreement is deemed valid only upon receipt of a separate (second) e-mail confirming the order and informing you of the shipment date of the ordered products. The confirmation of your order is subject to receipt of full payment of the ordered products.
(f) All prices are displayed and charged in Swiss Francs and include Swiss VAT. Prices are exclusive of (i) delivery costs and (ii) potential customs charges (which may apply for the shipping to countries outside of Switzerland), unless such charges are explicitly and separately listed on your final invoice.
(g) MCC SA accepts the following forms of payment: Visa, Mastercard, American Express. Powered by Stripe.
(h) Items are shipped directly from CM SA in Zurich, Switzerland, within four to eight business days. International orders may experience delays and take longer to arrive. Shipment is made through Swiss Post.
(i) All responsibility and risks for the products will pass to you upon dispatching of the products by MCC SA with the carrier.
(j) MCC SA accepts complimentary returns within 14 days of receipt, if the purchased item is unused and in original condition. Shipment is at your cost. It is your responsibility to ensure that any products being returned are properly packed and duly insured until delivered to MCC SA.
4. Warranties and disclaimers
Subject to the express provisions set out in these Terms and Conditions and to the maximum extent permitted by applicable law, MCC SA hereby disclaims all warranties (express, implied or statutory) in relation to the Website and the Purchases.
MCC SA is not responsible and accepts no liability for any inaccuracies, errors or omissions in the content of the Website or for the results of its use. MCC SA does not endorse, and is not responsible for the contents of any website referred to by or accessible from the Website. Links are provided for informational purposes only and are accessed at the user’s own risk.
5. Liability and indemnity
The information, artworks and products displayed on the Website are provided for general information purpose only and without any guarantees, conditions or warranties as to their accuracy or quality.
To the maximum extent permitted by applicable law, MCC SA hereby expressly excludes liability in contract, tort, negligence, statutory duty or otherwise arising out of or in connection with the use of or access to the Website or the Purchases.
To the maximum extent permitted by law, MCC SA’s maximum aggregate liability under or in connection with your use of the Website or the Purchases, whether in contract, tort or otherwise, shall be limited to the value of the products that you purchase from MCC SA through the Website.
MCC SA shall not be liable for any delay or failure to perform any of its obligations under these Terms and Conditions if performance of such obligations is prevented by an event or by matters beyond MCC SA’s reasonable control.
6. Intellectual property rights
All materials, including photographs, artworks and designs that are displayed on the Website are protected by copyright and/or other intellectual property rights and all rights remain reserved to the rights owner. The unauthorised reproduction, distribution or retransmission of the material contained in the Website is prohibited.
All trademarks and logos which appear on this Website are registered and unregistered trademarks owned by or licensed to MCC SA. The use of any trademark displayed on the Website, or any other content on the Website, is prohibited, unless written approval is obtained by MCC SA or the respective rights owner.

MCC SA reserves the right to unilaterally modify these Terms and Conditions at any time without prior notice. By using the Website after any modification of the Terms and Conditions, you agree to the updated Terms and Conditions.
To the maximum extent permitted by law, these Terms and Conditions shall be governed by and construed in accordance with the laws of Switzerland without regard to its conflicts of law provisions and the United Nations Convention on Contracts for the International Sale of Goods (CISG). Any dispute arising out of or in connection with these Terms and Conditions shall be submitted to the exclusive jurisdiction of the competent courts in Zurich, Switzerland.
Unless otherwise specified, the information and materials in the site are presented solely for the purpose of promoting the artworks, products and services available of CM SA. CM SA makes no representation that the artworks, products and services are appropriate or available for use in every country of the world. You use the Website at your own risk and are responsible for compliance with applicable local laws.
If any provision, or part of a provision, of these Terms and Conditions, is found to be illegal, invalid or unenforceable, that provision or part-provision shall be deemed not to form part of these Terms and Conditions, and the legality, validity or enforceability of the other provisions of these Terms and Conditions shall not be affected.
